 429      CONFLICT OF INTEREST – EMPLOYEES

I.          PURPOSE

The purpose of this policy is to observe Federal regulations that require the School

District to maintain a written conflict of interest policy as part of its written standards of

conduct.

II.        GENERAL STATEMENT OF POLICY

It is the policy of the School Board and School District to contract for goods and

services in conformance with Federal regulations and in a manner that will avoid any

conflict of interest or the appearance thereof.

III.      NOTIFICATION

Staff will receive annual notification of policy. The policy will be posted on the ISD#12

website.

IV.       DEFINITION

A. A conflict of interest is a direct or indirect financial or other benefit received as a result of an action taken by or influenced by a District employee, officer or agent on behalf of the District.

B. An indirect financial or other benefit includes benefits received by an employee, officer or agent’s:

a. Immediate family

b. Partner

c. Organization that currently employs, or is about to employ an employee, officer, or agent’s immediate family or partner.

V.        PROHIBITIONS

A. No employee, officer or agent may participate in the selection, award or administration of a contract supported by a Federal award if he or she has a real or apparent conflict of interest.

B. Solicitation or acceptance of gratuities, favor or anything of monetary values from contractors or parties to subcontracts is prohibited unless the unsolicited values is nominal as defined in an in accordance with Policy #706 Acceptance of Gifts.

VI.       DISCLOSURES

A. Any potential or actual conflicts of interest must be disclosed immediately and in writing to the Director of the Federal Program.

B. The Director of the Federal Program shall disclose in writing any potential or actual conflict of interest to the federal awarding agency in accordance with applicable Agency's policy.

C. Disclose in writing conflict of interest to MDE.

VI.       VIOLATIONS

Employees or officers who violate the provisions of this policy may be subject to discipline as defined in an in accordance with District Policy #403 Discipline, Suspension, and Dismissal of School District Employees, which may include:

a. Verbal Warning

b. Written Warning

c. Termination
